Participation Agreement

*(all services will be referred to as coaching in this agreement)

This agreement authorizes DaMarcus Morton to provide Coaching services described in this agreement. Below is an outline of DaMarcus’s policies and a description of what to expect in the services to be provided:

1) THE COACHING RELATIONSHIP

1a) Your Coach is part coach, part mentor, part teacher, and part accountability partner. Their goal is to help you discover within yourself the beliefs or issues that are blocking you from getting all you want out of life, and to help elicit from within you your own best solutions or new ways of being to live more of the life you want to live. Coaching is not therapy and Coaches are not therapist. A Coach does not diagnose or treat disorders. 

2) PARTICIPANT RESPONSIBILITIES/RESULTS

No recovery program can guarantee sobriety. For coaching to be most effective, the participant must make a commitment to take an active part in the process, which may include doing “homework” assignments and follow-up activities on your own time between sessions. It is important that you are truthful and authentic, saying what you believe and feel, sharing shortfalls as well as successes – and not just tell the coach what you think he wants to hear or what you might wish you could truthfully say. 

3) COACHING/COMMUNICATION

3a) Timing of meetings:

Groups/sessions are 45-75 minutes. Price structure doesn’t change for shorter sessions.

3b) Additional Client Contact with Coach:

Individual coaching participants may text/email coach up to 3 times between sessions. This could be to ask a question or share a win. Group participants will only have access to our free private accountability community. This group is peer driven but often visited by the coach.

4) FEES AND EXPENSES

4a) Billing rate:

Individual Coaching fees are due monthly unless otherwise agreed upon by DaMarcus Morton. Group fees are based on 1 session and due before the group begins.

4b) Client cancellation of a scheduled appointment:

Cancellation notice should be given by phone or email at least 3 hours before the individual session or group begins. Participants may be given the option of rescheduling but DaMarcus Morton is under no obligation to refund a missed session/group.

4c) Coach no-show:

If the Coach misses a scheduled group/session without advance cancellation notice, Coach will offer the participant the option of either rescheduling the group/session at a mutually agreeable time or receive a credit.

5) TERMINATION OF COACHING SERVICES

To get the greatest benefit out of working together, Coach and participant normally should begin the coaching relationship with the intention of working together for an initial period of three months. Coach may end the coaching relationship at any point.

6) CONFIDENTIALITY

6a) General confidentiality commitment:

I understand that my information will be kept confidential. Exceptions to confidentiality are provided under certain federal and state laws. In cases where safety is a concern, an exception to confidentiality exists, and it is legally mandated that confidentiality be broken to ensure safety.

6b) Group Confidentiality:

I agree to keep all information shared in groups/workshops confidential.

6c) Exceptions to confidentiality:

During their regular clerical duties, DaMarcus Morton’s staff, guest coaches/instructors will be privy to name and information of participants but is under the same strict requirements of confidentiality as is DaMarcus himself. Free groups/workshops may be recorded and used/publicly shared for promotional purposes.

6d) If a participant publicly makes false and slanderous claims about DaMarcus Morton, staff, volunteers, guest coaches/instructors work with the intent to harm them personally or professionally, DaMarcus Morton, staff, volunteers, guest coaches/instructors shall be at liberty to respond publicly to those false charges to protect their own personal and professional reputation.

7) COMMUNITY MEETUPS

DaMarcus Morton strongly recommends that you consult with your physician before participating in any physical activity.

You should be in good physical condition and be able to participate in the activities.

DaMarcus Morton, staff, volunteers, guest coaches/instructors are not licensed medical care providers and represents that they have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific activity on a medical condition.

You should understand that when participating in any activity, there is the possibility of physical injury. If you engage in an activity, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself, and agree to release and discharge DaMarcus Morton, staff, volunteers, guest coaches/instructors from any and all claims or causes of action, known or unknown, arising out of DaMarcus Morton, staff, volunteers, guest coaches/instructors negligence.

8) HOLD HARMLESS

Participant agrees to utilize DaMarcus Morton with the full understanding that, staff, volunteers, guest coaches/instructors are in no way responsible or liable for your decisions, actions and outcomes. You also agree to hold DaMarcus Morton, staff, volunteers, guest coaches/instructors free of all liability and responsibility for any adverse situations created as a direct or indirect result of a specific referral, advice given, or any actions taken while working with or because of working with DaMarcus Morton, staff, volunteers, guest coaches/instructors.
